How Eric Bird, operating under the Eric & Bria Bird brand, handles information connected with this website and direct lessons.

This Privacy Policy explains how Eric Bird, an individual operating under the Eric & Bria Bird brand (“Eric & Bria Bird,” “we,” “us,” or “our”), collects, uses, shares, and protects personal information in connection with our website, direct lesson inquiries, scheduling, payments, customer service, and optional marketing.

This policy applies only to information handled by Eric & Bria Bird. A studio or other business may have its own privacy policy when you purchase from or provide information directly to that business.

1. Information we collect

Depending on how you interact with us, we may collect:

  • Identity and contact information: first and last name, email address, and phone number.
  • Lesson and event information: whether you are preparing for a wedding or another goal, wedding or event date, lesson goals, experience level, preferred instructor, requested availability, referral source, partner or participant information that you choose to provide, and the contents of messages you send us.
  • Scheduling and service records: offered and confirmed appointment details, instructor, location, attendance, cancellations, courtesy-credit use, package balance, lesson history, and customer-service communications.
  • Transaction information: the lesson or package purchased, amount, payment status, transaction identifier, receipts, refunds, and disputes. Stripe processes card payments. We do not receive or store your full payment-card number.
  • Marketing information: whether, when, and how you opted in; subscription and unsubscribe status; and email delivery or engagement information supplied by Mailchimp.
  • Website and device information: IP address, browser and device type, pages viewed, referring page, approximate location derived from an IP address, campaign tags, and cookie or similar-technology data collected by our website and analytics tools.
  • Photos, video, or audio: only when you separately and voluntarily agree to media capture or use. Requesting or purchasing a lesson is not media consent.

Please do not place Social Security numbers, payment-card numbers, medical records, or other unnecessary sensitive information in an open message field.

2. How we collect information

We collect information:

  • directly from you through our website, email, phone, text, forms, waivers, and in-person interactions;
  • from services involved in a transaction or request, such as Stripe, our scheduling tools, and our website or customer-management systems; and
  • automatically through cookies, analytics, security logs, and similar website technologies.

If one member of a couple gives us information about the other participant, that person should have permission to do so.

3. How we use information

We use personal information to:

  • respond to inquiries and recommend an appropriate lesson option;
  • check availability, offer an exact appointment, and manage scheduling;
  • provide lessons, maintain package balances, and record attendance or cancellations;
  • process payments, receipts, refunds, and payment disputes;
  • communicate about appointments, purchases, policy changes, safety, and customer service;
  • document waivers, consent choices, and business records;
  • send promotional email only when you separately choose to subscribe;
  • understand website and campaign performance, improve our services, and prevent fraud or misuse; and
  • comply with legal obligations and establish, exercise, or defend legal claims when reasonably necessary.

A lesson inquiry or purchase allows us to send messages needed to answer the inquiry or service the purchase. It does not enroll you in promotional email or automated promotional text messages.

4. Optional marketing

Marketing consent is optional and separate from requesting, scheduling, or purchasing a lesson. Leaving the marketing box unchecked will not affect service or price.

If you opt in, we may use Mailchimp to send occasional lesson news, invitations, and offers. You may unsubscribe through the link in any marketing email or contact us at info@ericandbriabird.com. Unsubscribing from marketing does not stop appointment, payment, safety, or other service-related communications.

We do not enroll a phone number in automated promotional text messages based only on a lesson inquiry or purchase.

5. How we disclose information

We disclose only the information reasonably needed for the purposes described in this policy. Recipients may include:

  • WordPress and our website, hosting, domain, and email providers, which help operate the website and communications;
  • Fuego Portal, which supports inquiry, customer, scheduling, and operational records;
  • Stripe, which processes payments, refunds, receipts, and disputes;
  • Intuit Mailchimp, which manages optional email subscriptions, campaigns, and unsubscribe records;
  • Google Analytics, Google Tag Manager, Meta, or similar analytics and advertising-measurement providers, which are currently enabled on our public lesson pages and may receive website, device, cookie, referral, and campaign-performance information. We do not intentionally send the contents of lesson-request fields to analytics or advertising platforms;
  • a studio or venue, when limited scheduling, access, safety, or incident information is reasonably needed to host a lesson;
  • professional advisers and vendors, such as bookkeeping, legal, insurance, security, and technical-support providers, when they need the information to perform services for us; and
  • government bodies, courts, insurers, or other parties, when reasonably necessary to comply with law, respond to valid legal process, protect safety or rights, investigate misuse, or address a claim.

These providers may process information under their own privacy notices and service terms.

If the business is reorganized, sold, or transferred, information may be disclosed as part of that transaction subject to appropriate protections and applicable law.

6. Data sales and advertising choices

We do not sell lesson-request or contact lists, and we do not exchange personal information for money. We do not provide lesson-request information to third parties for their own direct marketing.

As disclosed above, Google, Meta, or similar services may collect website, device, cookie, referral, and campaign information when analytics or advertising measurement is enabled. Depending on the technology, configuration, and law that applies, some of that processing may be treated as targeted advertising or another type of regulated disclosure even though we are not paid money for the information.

You may request an applicable targeted-advertising or privacy opt-out by emailing info@ericandbriabird.com with the subject Privacy Opt Out. We will apply the request where required and to the systems reasonably associated with the information you provide. If our practices materially change, we will update this policy and provide any additional choice required before applying the new practice.

7. Cookies and analytics

Our site and service providers may use cookies or similar technologies for site operation, security, analytics, attribution, and campaign measurement. Browser settings and privacy tools may allow you to block or delete cookies, although doing so can affect site features. You may also send an applicable targeted-advertising or privacy opt-out request as described in Section 6.

8. Retention

We keep personal information only as long as reasonably necessary for the purposes described above. Our normal targets are:

  • inquiry records that do not become customer records: up to 24 months after the last interaction;
  • lesson scheduling and nonfinancial service notes: up to 3 years after the last lesson or interaction;
  • payment, refund, tax, contract, waiver, and dispute records: up to 7 years after the relevant transaction or last participation;
  • marketing records: while you are subscribed, followed by a limited suppression and consent record for as long as reasonably needed to honor your unsubscribe choice and document consent; and
  • separately authorized media: for the period described in the media consent, subject to any prospective withdrawal rights stated there.

We may retain information longer when reasonably needed for a legal claim, investigation, security incident, tax or accounting requirement, or valid preservation request. Deletion from backups may occur on a delayed cycle.

9. Your choices and Texas privacy requests

You may ask us to provide access to, correct, or delete personal information associated with you. You may also withdraw optional marketing consent at any time and may withdraw optional media permission for future uses as described in the separate media consent.

Texas law may provide eligible Texas residents additional rights, depending on the circumstances and any applicable exception. Those rights can include confirming whether personal data is being processed, accessing it in a portable format, correcting inaccuracies, deleting certain data, and opting out of sale, targeted advertising, or certain profiling. We do not retaliate against a person for making a good-faith privacy request.

We will use request information only to verify and respond to the request. Some information may be retained where reasonably necessary to complete a transaction, maintain financial or legal records, protect safety and security, or comply with law.

If we decline all or part of a request, you may reply with the word Appeal and explain why you would like us to reconsider. We will review the appeal and provide information about any further avenue available under applicable law.

10. Adults only

Direct lessons offered under these terms are for adults age 18 or older, and our services are not directed to children. Please do not submit information about a minor. If we learn that we collected a minor’s information in connection with a direct lesson request, we will take reasonable steps to delete it unless retention is required by law or needed for safety.

11. Security

We use reasonable administrative, technical, and organizational measures appropriate to a small lesson business. These include limiting access, using established providers for payment and customer systems, and avoiding storage of full card numbers. No internet transmission or storage system can be guaranteed completely secure.

13. Changes to this policy

We may update this policy as our services or providers change. We will post the updated version with a new “Last updated” date. If a change materially affects how we use information already collected, we will provide additional notice or seek consent when reasonably required.
