Lesson and Payment Terms

Clear terms for direct private-lesson pricing, scheduling, cancellations, package value, and refunds.

These Lesson and Payment Terms (“Terms”) apply to private dance lessons purchased directly from Eric Bird, an individual operating under the Eric & Bria Bird brand (“Eric & Bria Bird,” “we,” “us,” or “our”). Please read them before paying.

These Terms do not govern a lesson purchased from or billed by DanceMakers of Texas or another studio. A studio-billed purchase is governed by that seller’s terms. A direct Eric & Bria Bird lesson may take place at a studio, but the lesson location does not change the seller identified at checkout and on the receipt.

1. Who may participate

Our direct lessons are currently for adults age 18 or older only. Every participant must be at least 18 and must complete any required participation waiver before entering the dance floor. We are not currently accepting direct bookings for minors.

2. Direct lesson offers

The following launch offers are available unless a written offer shown before payment states otherwise:

Each lesson includes one instructor, Eric or Bria. The exact slot offer will identify the instructor. Bria is available for offered appointments beginning August 31, 2026. A stated price covers one student or one dancing pair and includes ordinary studio floor use. Any requested travel, special venue, event admission, or unusual facility cost must be quoted and agreed to separately before payment.

The New Student Starter is available once to a new direct independent student or new direct independent dancing pair. The two lessons are normally completed within 21 days of the first lesson. Scheduling delays caused by us or the studio do not reduce the student’s paid value. A package belongs to the student or pair named at purchase.

These are one-time purchases. There is no subscription, automatic renewal, gift card, or recurring charge.

3. How an appointment becomes reserved

  1. You send a lesson request.
  2. We check the live studio scheduling calendar and offer a specific date, start time, instructor, and location in a personalized written message.
  3. Only after that exact slot is offered do we provide the applicable private payment link.
  4. After successful payment, we immediately check the live studio scheduling calendar again.
  5. The appointment is final only when we send a written booking confirmation after that second check.

An inquiry, preferred time, invoice, payment receipt, or unpaid checkout link is not a final booking confirmation. If payment arrives after an offer deadline or the offered slot cannot be finalized during the second check, Section 6 applies.

For a four-lesson package, after the second live-calendar check and written confirmation, only the first offered appointment is reserved. The remaining lessons are scheduled individually against the live studio scheduling calendar. A package does not guarantee a recurring day, time, studio, or instructor.

4. Lesson timing and instructor

A lesson lasts 45 minutes from its confirmed start time. Arriving late does not extend the scheduled end time when another lesson or studio obligation follows.

Your confirmation identifies Eric or Bria as the instructor. If we need to substitute the other instructor, you may accept the substitution, reschedule without penalty, or receive a refund for the affected lesson.

5. Client cancellation, rescheduling, and no-shows

Notice is measured backward from the confirmed lesson start time.

  • With at least 24 hours’ notice, you may reschedule or cancel without using the lesson. If you request a refund instead of rescheduling, Section 7 applies.
  • With less than 24 hours’ notice, the lesson is charged and a package credit is used.
  • If you do not attend and do not give notice before the start time, the lesson is a no-show, is charged, and a package credit is used.

One courtesy late-cancellation exception

Once during any rolling 12-month period, we will restore the lesson or package credit used for one late cancellation when notice was given before the lesson started. The courtesy exception:

  • applies per named student or dancing-pair account, not once per instructor or purchase;
  • must be requested; and
  • does not apply to an uncommunicated no-show.

A restored courtesy credit remains subject to the package’s original 12-month discounted lesson-credit window and the value-preservation rule in Section 8.

6. Cancellation by us or by the studio

If an offered slot cannot be finalized after payment, you may choose another mutually available appointment or a full refund of that purchase.

If Eric & Bria Bird or the hosting studio later cancels or cannot provide a confirmed lesson, no lesson credit is used and your courtesy exception is unaffected. You may choose either:

  • a mutually available replacement appointment; or
  • a refund of the amount attributable to the affected lesson.

For a single lesson, the refund is the amount paid for that lesson. Each New Student Starter lesson has a refundable value of $37.50. For a package, you may reschedule the affected credit or cancel and receive the remaining package balance calculated under Section 7. We are not responsible for indirect expenses such as travel, childcare, clothing, or event costs.

7. Refunds

Seven-day full-refund period

You may receive a full refund within 7 calendar days after purchase if the purchase is wholly unused. A lesson is “used” when it is completed or charged under the late-cancellation or no-show rule. A courtesy credit that has been restored is not treated as used.

New Student Starter and single lessons

After the seven-day period, an unused single lesson or unused New Student Starter lesson remains refundable if you cancel before the 24-hour cancellation deadline. If one starter lesson has been completed or consumed, the remaining unused lesson has a refundable value of $37.50. A completed, late-cancelled, or no-show lesson is not refundable, except when a courtesy credit is restored or we or the studio cancelled it.

Four-lesson package

When any package lesson has been used, completed or charged lessons are repriced at the regular $100 single-lesson rate. The remaining refundable balance is:

There is no additional refund or administrative fee. To request a refund, email info@ericandbriabird.com or call 801-376-7942. We will issue a refund due under these Terms to the original payment method within 10 business days after receiving the request. Your bank or card issuer may take additional time to post it.

8. Twelve-month discounted lesson-credit window and preserved paid value

For 12 months after purchase, each remaining package credit may be booked and taken as one discounted 45-minute lesson, subject to availability.

At the end of 12 months, the discounted lesson-credit window ends. Unused paid value does not expire or become forfeited. At your choice, the remaining refundable balance shown in Section 7 may be:

  • applied as dollar credit toward then-current direct Eric & Bria Bird lesson pricing; or
  • refunded under Section 7.

No dormancy or inactivity fee is charged. A dollar credit is applied only after we offer an exact available appointment; it does not create a recurring reservation.

9. No transfers, resale, or gifts

A New Student Starter, single lesson, package, or dollar credit may not be transferred, shared, resold, or assigned and is not offered as a gift card. A purchase may be used only by the adult student or dancing pair named at purchase. Contact us before payment if the participant names need correction.

10. Payment processing and taxes

Stripe processes online card payments and may send the receipt. We do not receive or store your full card number. The checkout and receipt will identify the direct seller.

Prices include ordinary studio floor use. If a tax or separately requested special cost is legally required, it will be disclosed before payment rather than added after purchase without your agreement.

11. Participation waiver, health, and safety

These Terms govern scheduling and payment; they are not a liability waiver. Each participant must review and sign a separate participation waiver before the first lesson. Please disclose a relevant restriction directly to the instructor, work within your own limits, and stop if an activity causes pain or feels unsafe. Dance instruction involves physical activity, and no particular result or event outcome is guaranteed.

12. Photos, video, and audio

Buying or attending a lesson does not give us permission to use your image, voice, story, wedding details, or lesson footage for promotion. Promotional capture or use requires a separate, optional media consent. Declining media consent does not affect eligibility, scheduling, service, or price.

If you separately consent, that consent will state the permitted media and uses. You may withdraw permission for future use by contacting info@ericandbriabird.com, subject to the terms of that consent and material already lawfully published or produced before withdrawal.

13. Communications and marketing

By making an inquiry or purchase, you agree that we may use the contact information you provide for responses, scheduling, receipts, lesson reminders, policy notices, safety, and customer service. Promotional email requires a separate optional consent. A lesson request, terms acceptance, payment, or waiver is not marketing consent.

14. Privacy

Our Privacy Policy explains how we handle personal information. Stripe, a studio, and other services may also apply their own privacy policies to information they receive directly.

15. Changes and existing purchases

The version shown to you at purchase governs that purchase. We may update these Terms for future purchases by posting a revised date. We will not reduce the paid value of an existing package by changing these Terms after purchase.

If a provision cannot be enforced, the remaining provisions continue to apply to the extent allowed. These Terms do not limit a right that cannot lawfully be limited.
